RACECRAFT TERMS AND CONDITIONS

These Terms and Conditions (“Terms”) govern the access to and use of the facilities, services, and activities offered by Racecraft Limited (“Racecraft” or “the Company”), a premium entertainment venue located in Abu Dhabi, United Arab Emirates. Racecraft is a multi-purpose entertainment venue combining immersive motorsport simulation with premium e-entertainment offerings.
Our facilities include:
• Sim-racing entertainment zone featuring high-performance simulators with force feedback.
• Retail services for simulators, accessories, apparel, and racing-related products.
• Private rooms for PlayStation gaming or media viewing.
• High-spec PC gaming room equipped with custom-built gaming PCs.
• Professional coaching services conducted in a dedicated coaching area.
• Complimentary refreshment station offering tea, coffee, and other beverages.
1.1 Racecraft welcomes guests of all ages. For visitors under eighteen (18), participation is understood to be with the knowledge and consent of a parent or guardian. By entering, booking, or participating in Racecraft’s facilities or services, you agree to be bound by these Terms and all related policies.
1.2 Visitors acknowledge that participation in Racecraft activities involves inherent risks, including but not limited to physical injury, property damage, or equipment malfunction. All participation is undertaken at the visitor’s own risk. Racecraft shall not be liable for any injury, loss, or damage arising from the use of its facilities, equipment, or services, including situations caused by a visitor’s misrepresentation of age, negligence, or failure to follow staff instructions.
1.3 Visitors, including parents or guardians, agree to indemnify and hold harmless Racecraft, its affiliates, staff, and representatives from any claims, damages, or losses arising from the visitor’s participation, including those resulting from the actions of minors under their care. For full indemnity terms, see Section 19. This indemnity survives the termination of any visit or engagement with Racecraft.
1.4 Visitors are advised to read and comply with all posted safety signage and staff directions at all times.
For the purpose of these Terms and Conditions:
2.1 “Racecraft,” “we,” “our,” or “us” refers to Racecraft Limited, the operators and management of Racecraft, including all affiliated services, facilities, and representatives.
2.2 “Visitor,” “User,” or “Client” refers to any individual who enters the Racecraft premises, whether as a participant, guest, guardian, or spectator, and includes any individual who engages with Racecraft’s services, products, or equipment by purchasing or renting Racecraft’s products and services.
2.3 “Affiliate” means any entity that controls, is controlled by, or is under common control with Racecraft, where “control” means ownership of 50 percent or more of shares or voting rights.
2.4 “Device” means any device used to access the Service, such as a computer, cellphone, or tablet.
2.5 “Activities” refers to participation in racing simulators, gaming consoles, VR equipment, and other entertainment services provided by Racecraft.
2.6 “Entertainment Zone” refers to the dedicated retail and experiential area within the Racecraft venue where simulators, gaming areas, and visitor activities occur.
2.7 “Guardian” refers to a parent or legal guardian of a user under eighteen (18) years of age.
3.1 Admission to Racecraft’s Entertainment Zone is open to all individuals who agree to comply with these Terms.
3.2 Access to specific services or facilities (such as simulators, private rooms, or coaching) may be subject to booking availability, technical requirements, and/or age or skill suitability.
3.3 Racecraft operates during the following hours:
• Friday to Sunday: 10:00 AM – 12:00 AM.
• Monday to Thursday: 10:00 AM – 10:00 PM.
These hours are subject to change at Racecraft’s discretion.
3.4 Visitors must arrive at least five (5) minutes before their scheduled booking time. Late arrivals may result in session cancellation with no refunds, vouchers, or rescheduling.
3.5 Racecraft reserves the right to deny admission, restrict access, or remove any individual who (a) violates these Terms; (b) fails to comply with staff instructions or safety protocols; or (c) poses a risk to the safety, comfort, or enjoyment of others.
4.1 Visitors agree to use Racecraft services only for lawful purposes and in accordance with these Terms.
4.2 Each service has specific age restrictions, clearly indicated for each Activity. Users are responsible for ensuring they meet these requirements.
4.3 Users may not:
(a) use services in violation of UAE laws, including Federal Decree-Law No. 34/2021 on Combating Cybercrimes;
(b) attempt to interfere with, reverse-engineer, or disrupt simulators or website functionality; or
(c) use services for commercial purposes without prior written consent.
4.4 Racecraft will not be held liable for any misrepresentation made by a User under 18 years of age who appears to be 18 years or older. If a User misrepresents their age or gains entry based on appearance, Racecraft assumes no responsibility for resulting issues or incidents, and no refunds shall be due.
5.1 Certain features may require account registration. Visitors agree to: (a) provide accurate and complete information; (b) keep account credentials confidential; and (c) notify Racecraft immediately of any unauthorised account use.
5.2 We collect limited personal information, such as name and email address, as outlined in our Privacy Policy. Biometric data (for example, thumbprints for e-signatures or authentication) may be collected where required for authentication and in compliance with UAE and ADGM data-protection laws.
5.3 Racecraft reserves the right to suspend or delete accounts in cases of inactivity, suspected misuse, or violation of these Terms. Where practicable, Racecraft will provide notice to the account holder prior to deletion—a minimum of seven (7) days’ notice will be given where reasonably practicable—unless immediate suspension is required for suspected unlawful or dangerous activity.
6.1 Racecraft may offer subscription or loyalty membership programs providing exclusive access, benefits, or discounts.
6.2 Details of subscription plans, benefits, pricing, and terms are provided on-site or via official communication channels.
6.3 Participation in any subscription or loyalty program is subject to the specific terms applicable to that program, which may include:
(a) payment of fees in advance;
(b) non-transferability of membership rights;
(c) compliance with Racecraft’s general Terms and Code of Conduct; and
(d) revocation of benefits for misuse or policy violations.
6.4 Racecraft may modify, suspend, or discontinue any program at its discretion without prior notice.
6.5 Cancellation or refund requests for loyalty memberships must comply with the applicable membership terms provided at the time of purchase.
7.1.1 Simulator sessions are available in time blocks of 20, 40, or 60 minutes, with pricing based on both the selected duration and the specific type of simulator used, as per Racecraft’s discretion.
7.1.2 All simulators stationed within the Entertainment Zone operate using Assetto Corsa. Other leading racing simulation platforms may be added at Racecraft’s discretion in the future in accordance with Racecraft’s corporate licensing agreements. Under no circumstances may external software, games, or unauthorised programs be installed on or run from Racecraft’s in-house simulator systems by visitors.
7.1.3 User Guidelines:
(a) Simulators must be operated only under staff supervision and in compliance with safety protocols.
(b) Visitors are strictly prohibited from modifying hardware or software configurations.
(c) Online racing access may be available during advanced or scheduled sessions only.
7.2.1 Racecraft offers fully assembled simulators for personal, commercial, or institutional purchase, in accordance with these Terms and any accompanying Service Level Agreement (SLA).
7.2.2 Custom Configuration: Visitors may request specific racing simulation software, subject to availability. Installation, licensing, and calibration are available at an additional cost.
7.2.3 Hardware Options: Purchasers may choose from pre-determined simulator models with fixed core specifications and limited cosmetic customisations.
7.2.4 Support Services: After-sale services, technical support, delivery, and installation can be arranged subject to charges and availability.
7.2.5 Stock Availability: Certain simulator models, parts, or accessories may be out of stock or subject to supplier timelines.
7.2.6 Installation and Test Drive: A test drive will be conducted upon installation to confirm functionality. Once installation and test drive are completed, Racecraft shall not be liable for later issues unless covered by warranty.
7.3.1 Racecraft offers simulator rental solutions for corporate functions, brand activations, private parties, exhibitions, and off-site events.
7.3.2 Advance Booking Requirement: All rentals must be booked in advance with sufficient notice for preparation and logistics planning. Availability is subject to confirmation by Racecraft.
7.3.3 Custom Packages: Rental packages may include single or multiple simulator units, branded content or theming, on-site Racecraft staff for setup, operations and safety oversight, and leaderboards/tournament formats.
7.3.4 Pricing Structure: Rental charges are based on simulator type, duration, location, logistics, staffing, and technical requirements.
7.3.5 Visitor Responsibilities: Visitors engaging Racecraft for off-site rentals must ensure:
(a) site safety and security;
(b) adequate power supply and technical support;
(c) sufficient space and access for setup; and
(d) necessary permits or permissions.
7.3.6 Compliance: Clients must comply with all provisions of these Terms, including liability, cancellations, insurance, and return conditions.
7.3.7 On-Site Coordination: A designated representative must be present during setup, event, and breakdown.
7.4.1 Scope and Purpose:
This Section supplements these Terms and Conditions and applies to all venue hire, exclusive-use bookings, and offsite equipment rental activities offered by Racecraft Limited (“Racecraft” or “the Company”). It governs the use of Racecraft’s facilities for private or corporate events, brand activations, and external installations of Racecraft racing simulators and related equipment. The Racecraft event venue and facilities are located at M102, Radiant Square, Tamouh Street, Al Reem Island, Abu Dhabi, United Arab Emirates (the “Venue”).
7.4.2 Application and Acceptance:
(a) These Terms govern all venue hire and equipment rental arrangements provided by Racecraft, including private or corporate events and offsite simulator rentals.
(b) By booking, reserving, or otherwise engaging Racecraft—whether verbally, in writing, or through any online or offline channel—Clients acknowledge that they have read, understood, and agreed to be bound by these Terms and Conditions in full.
(c) These Terms apply equally to individuals, companies, agencies, and organisations engaging Racecraft’s services, irrespective of whether a separate written agreement is executed.
(d) For large-scale, complex, or multi-day activations, Racecraft may issue a dedicated Event Venue Rental Agreement or Offsite Equipment Rental Agreement. In the event of a direct inconsistency between these Terms and a separate, duly executed Event Venue Rental Agreement or Offsite Equipment Rental Agreement, the provisions of that separate written agreement shall prevail to the extent of such inconsistency.
(e) Unless otherwise documented or agreed in writing, full payment is required in advance for all event bookings, venue hires, and offsite rentals. Walk-in simulator sessions and individual coaching bookings may, at Racecraft’s discretion, be paid upon arrival.
7.4.3 Rental Fees, Rates & Attendance Limits:
(a) The duration of the pre-event setup period and post-event clearance period shall vary depending on the nature, scale, and duration of the event. In circumstances where such periods necessitate the closure or restricted use of the venue beyond the standard hire period, Racecraft reserves the right to levy additional charges to the Client for the extended occupancy or loss of business resulting therefrom.
(b) The venue shall be made available to the Client strictly at the agreed commencement time of the event and must be fully vacated by the agreed conclusion time. No complimentary extensions shall be granted. Any occupancy, use, or presence of the Client, its agents, or guests beyond the contracted period shall constitute a breach of this Agreement, and Racecraft reserves the right to impose additional charges, penalties, or other remedies as deemed appropriate.
(c) The standard hourly rate applies to events with up to twenty-five (25) participants and guests. Attendance exceeding this number will incur a capacity surcharge determined by Racecraft, based on staffing, equipment, and operational requirements.
(d) Large-scale events (typically exceeding fifty [50] persons) require Racecraft’s prior written approval and are subject to Venue capacity, safety regulations, and Radiant Square building rules. Racecraft reserves the right to decline or reconfigure events that, in its reasonable opinion, may compromise safety, operations, or guest experience.
(e) Unless expressly stated otherwise, quoted rates exclude branding, decorations, staging, or other non-standard arrangements. Additional charges apply for such customisations.
(a) Racecraft shall provide access to its in-venue simulators, audiovisual systems, furniture, and related facilities, along with standard technical support.
(b) Racecraft will ensure the availability of a sufficient number of operational simulators appropriate for the event. The number of simulators provided may vary based on operational circumstances or concurrent offsite rentals; such variation shall not, in itself, constitute a breach of these Terms.
(c) Clients must provide Racecraft with reasonable advance notice for any technical, logistical, or production requirements beyond Racecraft’s standard offering.
(d) Complimentary soft beverages and refreshments may be provided at Racecraft’s discretion (see also Section 11 on Complimentary Refreshments).
(e) Clients shall ensure that all third-party contractors or vendors comply with Racecraft’s operational, safety, and branding policies.
(a) All trucking, transport, and logistics for Equipment to and from the Event Site shall be arranged and paid for by the Client, unless otherwise expressly agreed and documented in writing that Racecraft will handle logistics.
(b) Where Racecraft coordinates or oversees transport, it shall do so with reasonable care but assumes no liability for third-party carrier delays, damage, or loss beyond its direct control.
(c) Racecraft staff may provide oversight during loading, unloading, and installation, and will supply safe-handling specifications for transport.
(d) The Client must provide accurate and timely site information, including loading and vehicle access, power supply, and any venue restrictions.
(e) The Client must ensure adequate power supply, space, and clearance per Racecraft’s technical requirements and shall provide any additional power or rigging required.
(a) Racecraft and the Client shall conduct a joint inspection before dispatch/delivery and upon return/collection of Equipment.
(b) A signed Condition Report (pre- and post-event) will record the state of all Equipment. Any loss or damage not noted in the pre-event inspection shall be chargeable to the Client.
(a) Title to all Equipment remains with Racecraft. The Client assumes all risk of loss, theft, or damage from the time Equipment leaves Racecraft’s control until safely returned, except for damage caused by Racecraft’s gross negligence or willful misconduct.
(b) The Client is not required to obtain insurance as a condition of hire; however, Racecraft strongly recommends maintaining insurance for property loss or damage and public liability during the Event.
(c) Racecraft may request proof of coverage for large-scale or high-risk activations and will notify the Client in advance if required.
(a) The Client is fully responsible for the conduct of all guests, employees, contractors, agents, and invitees present during the Event and for any loss of, or damage to, Racecraft’s property, including simulators, furnishings, fixtures, or installations, whether arising from negligence, misuse, spillage, or failure to follow instructions.
(b) Racecraft shall not be liable for indirect, incidental, or consequential damages, including loss of profit, revenue, or goodwill, even if advised of such possibility.
(c) Racecraft’s total aggregate liability under any rental or hire, whether in contract, tort (including negligence), or otherwise, shall in no event exceed the total amount of fees actually paid by the Client. Nothing in these Terms shall be construed to limit liability that cannot lawfully be limited under ADGM or UAE law.
(d) The Client shall indemnify and hold harmless Racecraft Limited, its shareholders, directors, officers, employees, affiliates, and agents (“Racecraft Indemnitees”) from and against any and all claims, proceedings, or damages arising out of:
(i) the Client’s use or occupation of the Venue;
(ii) any act, omission, or negligence of the Client or its guests, employees, or contractors;
(iii) any injury or damage to persons or property occurring during the Event; or
(iv) any breach of these Terms.
(See Section 19 for the full, consolidated indemnity framework that applies across Racecraft operations.)
(e) This indemnity survives the termination or expiry of any rental or hire.
(a) The Client acknowledges that participation in simulator racing and related activities involves inherent risks, including the risk of physical or emotional injury, property damage, or other harm.
(b) The Client voluntarily assumes all such risks on behalf of itself, its guests, and invitees.
(c) In consideration of being permitted to access and use the Venue or Equipment, the Client waives, releases, and discharges Racecraft and the Racecraft Indemnitees from any and all claims arising from any injury, loss, or damage, except where caused by Racecraft’s gross negligence or willful misconduct.
(d) This waiver is a material inducement for Racecraft to enter into any booking and is binding upon the Client and its successors or assigns.
(a) Any branding applied to the Equipment or Venue by the Client or its contractors must be pre-approved in writing by Racecraft.
(b) The Client warrants that such branding does not infringe any third-party rights and complies with applicable laws.
(c) Racecraft may refuse or remove branding it reasonably considers offensive, unlawful, or inconsistent with Racecraft’s brand standards.
(d) Branding does not confer ownership or intellectual property rights over the Equipment.
(a) Where Racecraft provides staff to operate or supervise Equipment, such staff retain full operational control and may suspend use for safety or technical reasons.
(b) The Client must not allow untrained or unauthorised persons to operate Racecraft Equipment.
(a) The Client shall ensure that all attendees behave safely and respectfully and comply with Racecraft’s policies, Radiant Square regulations, and ADGM public standards.
(b) Alcohol consumption is prohibited unless expressly approved in writing by Racecraft and compliant with UAE law.
(c) Smoking, vaping, and illegal substances are strictly prohibited throughout the Venue.
(d) Racecraft reserves the right to terminate any Event immediately—without refund—if guest behaviour endangers safety, breaches law, or risks reputational harm to Racecraft.
(a) Venue hire and offsite rentals are subject to the cancellation and refund provisions in Section 14. (See Section 23 for Force Majeure details.)
(b) For offsite events, the Client remains responsible for any irrecoverable logistics, transport, or staffing costs incurred by Racecraft where cancellation occurs without sufficient notice.
(c) Racecraft may reschedule or cancel events due to safety, operational, or force majeure causes and shall offer reasonable rescheduling or credit in accordance with these Terms.
(a) The Client must return the Venue in a clean and orderly condition. Costs for remedial cleaning, repair, or replacement due to misuse or negligence shall be chargeable.
(b) Access and clearance times are determined by Racecraft. Overtime beyond the agreed period will be charged at the prevailing hourly rate.
(a) All photographs, videos, or other media captured by Racecraft staff or contractors during any Event remain the exclusive property of Racecraft Limited.
(b) Racecraft may use such media for marketing, promotional, archival, or internal purposes without additional consent or compensation unless otherwise agreed in writing.
(c) Clients who wish to restrict the use of identifiable branding or participants must notify Racecraft in writing at least seven (7) business days before the Event. Racecraft will make reasonable efforts to accommodate such requests.
(d) CCTV and recording systems operate within the Venue for safety and security. Attendance constitutes consent to such monitoring. Data captured is handled in accordance with Racecraft’s Privacy Policy and ADGM data protection regulations.
Racecraft may, at its discretion, require execution of a separate Event Venue Rental Agreement or Offsite Equipment Rental Agreement for certain events. Such agreements supplement these Terms and shall prevail to the extent of any direct inconsistency.
All provisions concerning risk, liability, indemnity, insurance, payment, ownership, and media rights shall survive the termination or expiry of any event, rental, or hire.
8.1 Coaching Environment: All sessions are conducted in dedicated coaching areas, designed to ensure privacy, focus, and optimal equipment performance.
8.2 Coaching Instructors: Training is delivered by experienced professionals or semi-professional sim racers with extensive knowledge of racing principles, simulator dynamics, and software platforms.
8.3 Target Audience: Coaching is suitable for aspiring racers, sports competitors, or enthusiasts wishing to improve driving technique, racecraft, lap times, or technical understanding.
8.4 Fees & Booking: Coaching is a premium, appointment-only service and must be booked in advance. Sessions are subject to availability and may be rescheduled with notice as per the cancellation policy. The fee structure is based on duration and instructor expertise.
8.5 Session Structure: Options may include single-session intensives or structured multi-session packages.
8.6 Coaching sessions are non-transferable and non-refundable once commenced.
9.1 Features:
(a) Modern lounge furniture, including a sofa and casual seating;
(b) Large-format HD TV screen; and
(c) PlayStation gaming console with a selection of games.
9.2 Use Cases:
(a) Group gaming sessions;
(b) Private media viewing (films, replays, online content); or
(c) Birthday bookings or social gatherings.
9.3 Booking & Rates:
(a) Access is charged on an hourly basis and is subject to availability;
(b) Advance booking is strongly recommended.
9.4 Rules of Use:
(a) Only age-appropriate content is permitted;
(b) Visitors must ensure respectful use of the space and equipment;
(c) Food and drinks must be handled carefully to avoid damage or spills;
(d) Noise levels must remain reasonable and not disturb other guests.
10.1 Use is strictly for entertainment purposes.
10.2 Access is granted on a time-based rental model (hourly or sessional).
10.3 All gaming content must comply with UAE laws and moral standards.
10.4 Any illegal or unethical activity (including hacking, piracy, or offensive communication) is strictly prohibited.
10.5 Activity on Racecraft-owned computers may be monitored for compliance.
10.6 Parental consent is required for Users under 18.
11.1 From time to time, Racecraft may offer light refreshments to visitors as a courtesy.
11.2 Refreshments are for reasonable on-site personal consumption only.
11.3 Racecraft is not responsible for availability, quality, allergies, or satisfaction related to complimentary items.
(See also Section 7.4.4(d) and Section 12.8 for references to complimentary beverages and usage.)
12.1 Visitors must conduct themselves in a respectful, courteous, and responsible manner at all times.
12.2 Any form of aggressive, abusive, disruptive, discriminatory, or inappropriate behaviour may result in immediate removal without refund and possible permanent bans or legal action.
12.3 All Visitors must follow staff instructions, especially relating to safety, equipment use, and facility access.
12.4 Visitors must promptly vacate any area if directed to do so by staff for safety or operational reasons.
12.5 Visitors may not alter or tamper with hardware or software in any way.
12.6 Any damage caused intentionally or through negligence will be the financial responsibility of the Visitor or their guardian.
12.7 Food and beverages are prohibited near simulators, gaming PCs, and electronics.
12.8 Complimentary beverages are for moderate use only. (See Section 11.)
12.9 Visitors must maintain cleanliness and use designated bins.
12.10 All services must be booked in advance through Racecraft’s official system.
12.11 Visitors must adhere to allotted times; late arrivals may shorten sessions without refund.
12.12 Overstaying beyond the allocated time may incur additional charges.
12.13 Strictly Prohibited Conduct includes:
(a) use of illegal substances or intoxication;
(b) violation of UAE or ADGM laws;
(c) smoking, vaping, or tobacco use;
(d) illegal or offensive use of gaming systems;
(e) weapons or hazardous materials;
(f) unauthorised commercial activity, including filming or promotion.
12.14 Enforcement:
(a) Racecraft may request the immediate removal of violators and contact authorities if necessary;
(b) Racecraft reserves the right to refuse future entry and recover damages for disruption or misconduct.
13.1 Full Payment in Advance:
For all types of bookings, including Entertainment Zone sessions, event bookings, simulator rentals, and coaching sessions, full payment is required at the time of booking. For group bookings only, Racecraft may, at its discretion, allow one session to be scheduled without prior payment as an agreed preferred arrangement; subsequent sessions will require full payment in advance. (See also Section 7.4.2(e).)
13.2 Payment Methods:
Racecraft accepts payments through approved methods. Payments must clear before confirmation.
13.3 No Cash Refunds:
Racecraft does not provide cash refunds; eligible cancellations are handled under Section 14 (Refund and Cancellation Policy). Where refunds or credits are authorised, Racecraft will, where reasonably practicable, apply refunds as a credit or voucher to the original booking account or payment method used for the booking, unless otherwise expressly agreed.
13.4 Failure to Pay:
Failure to complete payment may result in cancellation without liability.
13.5 General Terms:
(a) All refund or cancellation requests must be made in writing or via email;
(b) Vouchers are processed within five (5) business days of approval;
(c) Racecraft reserves the right to withhold refunds for breaches of Terms, conduct violations, or property damage.
14.1 Entertainment Zone Bookings:
Cancellations for simulator sessions, coaching appointments, private room rentals, or PC gaming area bookings must be received at least 24 hours in advance of the scheduled session to be eligible for a refund voucher. Cancellations received with less than 24 hours’ notice will not be eligible for a voucher or rescheduling, and no refunds will be issued. No refunds, vouchers, or rescheduling will be provided for no-shows or unused time once a session has commenced. (See Section 23 for Force Majeure circumstances.)
14.2 Merchandise and Simulator Sales:
All sales of merchandise, simulators, hardware components, accessories, or custom configurations are final and non-refundable. Racecraft may, at its sole discretion, offer repairs, replacements, or partial credit in exceptional circumstances.
14.3 Event Bookings:
14.3.1 On-Site Events:
For events held at Racecraft’s premises, a minimum of one week’s advance written notice is required to cancel or reschedule without penalty. Cancellations made with less than one week’s notice may be subject to a cancellation fee or may not be eligible for any voucher or rescheduling option. If the cancellation is made within the required notice period (one week or more), the booking may be rescheduled based on availability, or a voucher will be issued for the full value of the event. Rescheduling requests must be submitted within one week of the original event date and are subject to availability.
14.3.2 Off-Site / External Events:
For events held at external venues, one week’s advance notice is required (subject to the scale and logistics of the event). If cancelled with at least one week’s notice, a voucher for the full value of the booking may be issued, or the event may be rescheduled based on availability. If cancelled with insufficient notice, Racecraft reserves the right to charge for any irrecoverable logistics costs, staff scheduling, equipment reservations, and other non-refundable expenses already incurred. The applicable notice period and cancellation conditions will be outlined in the booking confirmation. Rescheduling requests may be made within one week of the original event date, subject to availability, and can be submitted via email only.
15.1 To the fullest extent permitted by UAE law, Racecraft, its affiliates, and suppliers are not liable for any injuries, damages, or losses arising from the use of our simulators or services, including but not limited to misuse, improper handling, or user negligence. Users and their guardians assume all risks associated with simulator use. This includes physical injuries from improper use of simulators, data loss or corruption due to technical failures, third-party claims arising from user actions, and all activities within Racecraft’s Entertainment Zone. (See Section 1.2 and Section 7.4.9 for related releases and waivers.)
15.2 Liability Waiver and Release of Claims:
By entering or booking, Visitors acknowledge the inherent risks associated with Racecraft activities and, to the fullest extent permitted by law, release Racecraft from liability for personal injury, property damage, equipment malfunction, or emotional distress, including where such harm arises from negligence, except that nothing in these Terms limits or excludes Racecraft’s liability for death or personal injury resulting from Racecraft’s gross negligence or wilful misconduct.
15.3 Exclusions and Limitations of Liability:
Racecraft shall not be liable for:
(a) accidental injuries from misuse or failure to follow staff instructions or safety protocols;
(b) allergic reactions, illness, or discomfort resulting from complimentary refreshments or environmental factors;
(c) loss, theft, or damage to personal belongings brought into the venue;
(d) downtime, unavailability, or technical malfunctions of equipment or systems; and
(e) indirect, incidental, or consequential damages arising from the use (or inability to use) Racecraft services or facilities.
Racecraft’s total liability (if any) shall be limited to the total fees paid by the affected Visitor for the session or booking in question, subject to any non-excludable legal liabilities under ADGM or UAE law.
15.4 Nothing in these Terms shall limit or exclude liability that cannot lawfully be limited or excluded under ADGM or UAE law. To the extent there is any perceived overlap between indemnity provisions and liability limits elsewhere in these Terms, the parties should construe indemnity obligations (see Section 19) and liability caps together so they operate consistently and without contradiction.
16.1 Confidentiality Obligations:
(a) All information shared with Racecraft during registration, booking, participation in services, or through any other communication will be treated as strictly confidential.
(b) Racecraft will not disclose personal or commercially sensitive information to third parties without prior written consent, unless required by law.
(c) All Racecraft employees, contractors, and service providers are bound by internal confidentiality protocols.
16.2 Scope of Confidential Information:
Confidential information includes but is not limited to full name, contact information, identification documents, payment records, booking history, coaching session notes, simulator configurations, service preferences, and communications or materials not publicly available.
16.3 Data Protection Measures:
Racecraft implements reasonable and appropriate technical and organisational measures to prevent unauthorised access, use, alteration, or disclosure of personal or confidential data.
16.4 Data Retention:
We retain personal information only for as long as necessary to fulfil the purposes for which it was collected, or as required by applicable legal, regulatory, or insurance obligations. After this period, the data is securely deleted or anonymised.
16.5 Consent:
By registering at or using our services, Visitors provide explicit consent for the collection and processing of personal data in accordance with this policy. Where applicable, a signed consent form may be required at the time of registration or booking. See Section 17 (Privacy Policy) for further details on personal data handling and data subject rights.
17.1 Racecraft’s Privacy Policy governs the collection, use, and protection of personal information.
17.2 Racecraft does not knowingly collect data from users under thirteen (13) years of age without guardian consent, in compliance with UAE Personal Data Protection Law and international privacy standards.
17.3 The Privacy Policy forms part of these Terms and may be updated from time to time.
18.1 Marketing Communications:
By accessing Racecraft’s services, providing contact information, or booking an activity, Visitors consent to receive marketing and promotional communications from Racecraft, including newsletters, offers, event announcements, and product updates. Communications may be sent via email, SMS, phone calls, or other digital channels.
18.2 Opt-Out Option:
Visitors may opt out of marketing communications at any time by contacting Racecraft via email or using the unsubscribe options provided in communications.
18.3 Data Sharing:
Racecraft may share personal data, such as contact information, with affiliated companies, subsidiaries, and trusted business partners for marketing or operational purposes, provided such parties are bound by confidentiality and data protection obligations.
18.4 Data Retention for Marketing:
Personal data may be retained by Racecraft for an indefinite period for legitimate business, marketing, and record-keeping purposes, in accordance with applicable ADGM data protection regulations (unless otherwise restricted by local law or where the Visitor has exercised their data-subject rights).
19.1 Visitor Obligations:
By accessing or using Racecraft’s facilities or equipment, all Visitors and Clients agree to indemnify and hold harmless Racecraft, its owners, directors, employees, affiliates, and agents (“the Indemnified Parties”) from and against any and all:
(a) claims, suits, damages, losses, or penalties (including legal fees);
(b) acts or omissions of the Visitor or their dependents;
(c) injuries or damages caused on the premises or during service use;
(d) misuse or unauthorised access to Racecraft property or systems; or
(e) violations of UAE or ADGM laws.
This Section 19 contains the consolidated indemnity obligations that apply to Racecraft’s general operations, venue hire, offsite rentals, and Events; references to indemnity elsewhere in these Terms are to be read in the context of this Section.
19.2 Responsibility for Users:
Where a User causes damage or injury, their parent, guardian, or supervising adult will be fully responsible and must indemnify Racecraft accordingly.
19.3 Survival:
This indemnity obligation survives the termination or expiry of any session, booking, or agreement.
20.1 These Terms and Conditions and any disputes arising from them shall be governed by and construed in accordance with the laws of the Abu Dhabi Global Market (ADGM), United Arab Emirates.
20.2 In matters not covered by ADGM laws, UAE Federal Law shall apply to the extent relevant.
21.1 Amicable Resolution:
The Parties shall first attempt to resolve any disputes amicably through informal discussions.
21.2 Mediation:
If unresolved, disputes may be referred to mediation administered under the ADGM Arbitration Centre Mediation Rules 2020, unless otherwise agreed in writing.
21.3 Jurisdiction:
If mediation fails, either party may pursue legal remedies through the Courts of the Abu Dhabi Global Market (ADGM), which shall have exclusive jurisdiction.
22.1 Racecraft uses cookies and similar technologies to enhance user experience, remember preferences, and collect limited non-personal usage data.
22.2 By using Racecraft’s website or digital systems, Visitors consent to the use of cookies in accordance with Racecraft’s Cookie Policy.
22.3 Full details are available in Racecraft’s separate Cookie Policy accessible on its official website.
23.1 Racecraft shall not be liable for delays, interruptions, or non-performance caused by events beyond its reasonable control, including natural disasters, acts of government, war, civil unrest, epidemics, technical failures, or other unforeseen events.
23.2 Racecraft will make reasonable efforts to mitigate the impact of such events and resume operations promptly.
23.3 If a Force Majeure event delays performance beyond thirty (30) days, Racecraft may offer rescheduling, postponement, or refunds via voucher or credit at its discretion.
24.1 Racecraft reserves the right to modify, amend, or update these Terms at any time.
24.2 Updates will be published on-site and on the Racecraft website and take effect immediately upon posting.
24.3 Visitors are encouraged to review the Terms periodically for updates, as continued use of Racecraft’s services constitutes acceptance of the revised Terms.

If any provision of these Terms is found to be invalid, illegal, or unenforceable by a court or competent authority, the remaining provisions will continue in full force and effect.
The failure or delay by Racecraft to enforce any provision of these Terms shall not constitute a waiver of that provision or any other rights under these Terms. Any waiver must be in writing and signed by an authorised representative of Racecraft to be valid.
